For Web Services and Applications
This Policy applies to information collected by our applications for mobile and tablet devices, laptops, and desktops (the 'App') and the Crowded Fiction website (www.crowdedfiction.com, the 'Site'), except for applications and web services with separate privacy policies. We may refer to the App and the Site collectively as our 'Service.' We refer to the interactive books and other content offered through our service as 'Content.'
The company that operates under the Crowded Fiction brand and provides the Service is Vidya Gamer, LLC. (the 'Company'), based in Queen Anne, Seattle, WA (USA). You can contact us by email at email@example.com. We may also refer to the Company by words such as 'we,' 'us,' or 'our.'
1. Information We Collect and How We Use It
We collect information as described below. Our primary goals in collecting and using information is to create your account, provide Services to you, improve our Service, contact you, conduct research and create reports for internal use. We store information on servers located in the United States via Parse.com and may store information on servers and equipment in other countries.
1.1 Information You Input
You may input information to make use of certain features of our Service. For example, when you create an account with us you will enter information about yourself such as username, email address, and other relevant information we request.
When you purchase Content offered in the App using your account with a third party app store we do not collect the credit card information that you use for such purchases, and we are not responsible for the policies and practices of such app stores.
We use your account with us to allow Content that you have purchased or downloaded while logged in on one device to be accessible (synchronize) on all devices through which you access our Service while logged into your account.
1.2 Information We Collect Automatically
Your use of our Service generates information that the Company collects automatically. This section summarizes the important types of information that we may collect.
You may login to our Service using a third party social network service such as Facebook ("SN Service"). We may collect and record information through the SN Service in accordance with the policies and terms of that SN Service. The information we collect when you connect your user account to an SN Service may include: (1) your name, (2) your SN Service user identification number and/or user name, (3) locale, city, state and country, (4) sex, (5) birth date, (6) email address, (7) profile picture or its URL, and (8) the SN Service user identification numbers for your friends that are also connected to our Service(s).
Actions, Choices and Achievements
Whenever you use our App or Service, we collect data about all of your interactions with the Service and Content and with the other users of the Service via server log files. This data is stored within Parse.com Web Services.
We collect information about the different inputs, actions and choices you make while reading the Content and we collect the achievements that you unlock based on those actions and choices.
The aggregated information enables us to provide the outcome of the dilemmas and choices of the Content. We may then use that information to influence the direction of future Content.
We may use that information to compare your choices and achievements with those of your friends. Only friends authenticated by you in the SN Service will able to see your choices and achievements.
When you use our App on a mobile platform, we may collect and record certain information such as your unique device ID, hardware type, media access control (“MAC”) address, the version of your operating system (“OS”), your device name, your email address (if you have connected to Facebook), and your location (based on your Internet Protocol (“IP”) address). This information is useful to us for troubleshooting and helps us understand usage trends.
In addition, we create a unique user ID to track your use of our Service. This unique user ID is stored in connection with your profile information.
We may collect your email address when you contact our customer service group and we may use that email address to contact you about your gaming experience with our Service and notify you about company news and promotions.
We may also acquire information from you through (1) your access and participation in message boards on the Service, (2) your participation in surveys regarding the Service or (3) your participation in a sweepstakes or contest through the Service.
While you are browsing the Company websites such crowdedfiction.com or vidyagamer.com, your computer’s operating system, Internet Protocol (IP) address, access times, browser type and language and referring Web site addresses may be logged automatically. We may use this information to monitor and analyze your use of the Service. In addition, we may ask you to submit and we may process data that is personal to you, including but not limited to your name, profile photo, gender, age or birthday, links to your profiles on social networking websites and other third party sites, user names and e-mail and mail addresses. We may use this information to create a user profile. We may use your email address to contact you about your experience with our sites and notify you about company news and promotions. Your gender and birthday may be used to analyze user trends and target certain promotions. Your mail address may be used if we have merchandise or other physical promotional materials that we want to send to you.
We may at times offer you the ability to post content to a blog, message board, chat room or within the Company’s applications or other forums such as the Company’s Facebook page (“Forums"). You should be aware that any visitor to the Forums may read your postings on the Forums. Furthermore, any information that you may post to a Forum, including your username or other account profile information, will be disclosed and available to all users and viewers of that Forum, and will therefore no longer be private. We cannot guarantee the security of such information that is disclosed or communicated online in public areas such as the Forums, and you provide such information at your own risk. We do not author, edit, endorse, or monitor any Forum. You acknowledge and agree that the Company has no responsibility for the accuracy or availability of information provided on any Forum. We reserve the right at any time, in our sole discretion, to remove any content that a user may post on any Forum and restrict their access to any Forum.
Hardware, Software, and Network Data
We may collect information about the type and version of the device you use to access our Service, operating system, IP address assigned to the device by the third party providing Internet access to the device, unique device identifiers, and mobile network information, including mobile phone number. In the case of the App, this information may include an identifier generated by us or by the operating system of your device to enable us to identify the App that you have downloaded.
This information will, in the case of the App, enable us to provide to your device Content properly configured for that device, to keep a record of the Content that you purchase or download, and to analyze activity on the App. If you choose to create an account with us, that record will enable you to synchronize Content as described above.
We may use IP addresses to determine what State and zip code or Country the device is in. We may use that data to comply with various legal obligations, such as geographic restrictions on the distribution of certain Content and payment of taxes, to display geographically appropriate Content, policies, notices, and advertisements, and to better understand the geographic distribution of our customers. If required to meet our legal obligations, such as payment of taxes, we may use such data to obtain more specific information about the locations from which our services are used.
We may collect information about the Content that you purchase, place in your cart without purchasing, or search for or browse. We may use that information to recommend to you Content that we believe might interest you.
A cookie is a small text file that we transfer to your computer and/or device, to identify a user's computer/device and to "remember" things about your visit, such as your preferences or a user name and password. Information contained in a cookie may be linked to your personal information for purposes such as improving the quality of our Service, tailoring recommendations to your interests, and making the Service easier to use. You can disable cookies at any time, although you may not be able to access or use features of the Service.
Third Party Services
We may feature advertising within our Service. The advertisers may collect and use information about you, such as your Service session activity, device identifier, MAC address, IMEI, geo-location information and IP address. They may use this information to provide advertisements of interest to you. You can opt-out of personalized ads/recommendations from Flurry by clicking http://www.flurry.com/user-opt-out.html. In addition, you may see our App or Service advertised in other services. After clicking on one of these advertisements and installing our App, you will become a user of our Service. In order to verify the installs, a device identifier may be shared with the advertiser.
1.3 How We Use Information
We use information collected through our Service for purposes described in this Policy or disclosed to you in connection with our Service. For example, we may use your information to:
• create user accounts and allow users to use our Service;
• identify and suggest connections with other Crowed Fiction users;
• determine the outcome of dilemmas and choices within Content and to influent future content;
• operate and improve our Service;
• understand you and your preferences to enhance your experience and enjoyment using our Service;
• respond to your comments and questions and provide customer service;
• provide and deliver products and services you request;
• send you related information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
• communicate with you about promotions, rewards, upcoming events, and other news about products and services offered by Crowded Fiction and our selected partners;
• enable you to communicate with other users; and
• link or combine it with other information we get from third parties, to help understand your preferences and provide you with better services.
2. Information We Share
We may share your information with the following, or under any of the following circumstances:
Our corporate affiliates such as a corporate subsidiary.
Our current or prospective business partners, including publishers who provide content for any of our services, who have a need to understand the nature and operation of our business, such as sales and usage trends. Information provided in this respect is aggregated and not personally identifiable.
Third parties we have retained to perform services on our behalf, such as Content hosting and delivery, data analytics, marketing and advertising, and payment services.
In connection with a business transaction involving transfer of our Company or a business of ours, information relating to customers typically would be included in the assets transferred.
With your consent, for example, when you agree to our sharing your information with other third parties for their own marketing purposes subject to their separate privacy policies.
Crowded Fiction may engage other companies and individuals to perform services on our behalf. Example of these services include analyzing data. These agents and service providers may have access to your personal information in connection with the performance of services for Crowded Fiction
Crowded Fiction may share your information in connection with any merger, sale of our assets, or a financing or acquisition of all or a portion of our business to another company.
For the following reasons relating to legal matters or corporate responsibility based on our good faith assessment of the appropriate course under the circumstances: (a) as required by legal process or any law to which we are subject, (b) in response to a request by a court, law enforcement authority, or government agency or official that we believe would have the power to compel compliance if we refuse, (c) to protect our rights under our contracts, terms of service, and end user license agreements, and to otherwise protect our rights, (d) to protect the rights or welfare of others, including our employees and owners of copyright or other intellectual property in Content, (e) to prevent or mitigate physical harm to person or property or financial loss, (f) to assess or mitigate credit risk, and (g) to conduct any investigation relating to the foregoing.
We are based in the United States ('U.S.'). Any data collected in connection with our Service may be transferred to, processed, and stored within the U.S. or other countries in which we do business or our service providers transfer, process, or store data.
4. Children Under 13
We do not knowingly collect personal information from children under 13. Any parent or guardian who believes that a child may have provided personal information to us without the knowledge of that parent or guardian should contact us at firstname.lastname@example.org.
5. Data Security
The security of information relating to our customers is very important to us. We use reasonable methods to protect that information, and review and adjust those methods as appropriate. Although we make good faith efforts to store the information collected on the Service in a secure operating environment that is not available to the public, we cannot guarantee the absolute security of that information during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers" from illegally obtaining access to this information. We do not warrant or represent that your information will be protected against, loss, misuse, or alteration by third parties.
6. Links to Other Websites and Services
We may provide links to various third party websites and services. Those sites and services are not under our control. Those sites and services may have their own privacy policies, which we strongly suggest you review if you visit them or utilize them. We are not responsible for those third party privacy policies or the related data processing practices.
7. Changes to this Policy
We may change this Policy at any time and without prior notice to you. If the changes are material, we may notify you by posting or displaying a notice on our Service, by email, or by any other method we choose in our discretion. To view notices on our App, you may need to download the updated App as made available from time to time on the applicable app store. Changes are effective when the revised Policy is made available on our Service or through any other method we choose in our discretion, or at such later date as may be stated in the notice of change or revised Policy. Your use of the Service after a change is effective will be governed by the Policy as changed. The Policy in effect at any time governs our use of all information in our possession at that time. However, if we change the Policy in a way that materially reduces the protections afforded information collected prior to the change, we will not apply that change to that previously collected information without the consent of the affected customers. Please review this Policy from time to time while you are connected to the Internet so that you are aware of any changes. We will indicate above the effective date of this Policy.
